Seminar On Constitutional Justice Being Held in Yerevan

YEREVAN (Noyan Tapan)–The 5th international seminar "Effectiveness of Constitutional justice in transitional society" opened in Yerevan October 6. Armenian Prime Minister Andranik Margarian welcomed the participants of the seminar that was organized by the Constitutional Court of Armenia and EU Commission "Democracy through Law". The Armenian prime minister pointed out that disputes between different branches of power should be settled by means of Constitutional justice. "Otherwise–they transform into a serious political conflicts with negative consequences," the prime minister added. He also pointed out the need for increasing the number of entities of law that apply to the Constitutional Court.

At a briefing–Chairman of the Constitutional court of Armenia Gagik Harutiunian supported the prime minister’s opinion–as ordinary citizens are currently deprived of the right to Constitutional justice. In this context–the Constitutional Court is like "a black sheep"–as in other countries not only Parliament members–but also ordinary citizens have the right to inquire the Constitutional Court about the constitutionality of certain laws. In Armenia–the Constitutional Court may consider a similar issue provided that at least a third of the Parliament members apply to the Constitutional Court. In most countries–the constitutional justice bodies are entitled to consider disputes over constitutional authority of different branches of power. According to Harutiunian–with the exception of the aforementioned right–the Constitutional Court of Armenia has necessary and sufficient powers to administer constitutional justice.

Harutiunian pointed out that the topic of the 6th similar seminar scheduled for 2001 will be "Guarantees of independence of constitutional justice."
