Swiss Court Verdict Validity Questioned

BERN (Noyan Tapan)–The Swiss Neue Zurcher Zeitung newspaper reviewed the Swiss Court proceeding regarding the Armenian Genocide in its Monday’s edition.

Journalist George Krace stated that the Armenian Genocide issue has been investigated and proven true–however Turkish nationalist history still refuses to recognize it.

"The Genocide has been the subject for many publications in Switzerland as well–including the recently published memoirs of Jackob Quentsler–who was volunteer doctor in Anatolia in 1919. We agree that the extermination of 800 to 1.5 million Armenia’s–during the Young Turk regime is a historically documented reality–and it corresponds to the current definition genocide. It is a fact–regardless if the Swiss Court fails to recognize it as such. At the time–due to the lack of thorough investigations–the Genocide was not condemned–however–today there are world wide efforts to compensate for the indifference of the past," writes Krace.

He also stated that the historical truths must not be discussed in parliamen’s since they are the results of historical research. Grace stated that parliamen’s of many countries have condemned the Armenian Genocide–however the Swiss and US parliamen’s have failed to do so.

He stressed that although the Swiss Parliament failed to authenticate the Genocide Bill earlier this year (with a 70-73 loss) –nothing was added to the events that took place 80 years ago–however–the political standpoint of the parliament was revealed.

Regarding the charges brought against the Turks in the Swiss Bern-Lopen court–the journalist concludes that the Swiss court should not have discussed the reality of the genocide.

Instead–it had to make a decision whether the Turkish commen’s violated Swiss Criminal Law Code Section 260–while according to the personal opinion of Judge Mardel Alexander Nilie–the Turkish actions however were crime-related.

The case was based on Switzerland’s 1995 anti-racism law–making it a criminal offense to "deny–grossly minimize or seek to justify genocide or other crimes against humanity." Until now it was used only against those denying the existence of the Nazi Holocaust.
