Constitutional Court Member Suggest Amendmen’s

YEREVAN (Noyan Tapan)–The basic function of the state is to protect human rights–Constitutional Court member Felix Tokhian said–speaking at a discussion devoted to the second part of the Armenian Constitution "The main rights and freedoms of a man and citizen." He noted that the wording of the 4th count of the Armenian Constitution was poor: "The state protects the rights and freedoms of a man on the basis of the Constitution and laws and in conformity with the principles and norms of international law."

According to Tokhian–the Constitution should make clear that individuals have the right to apply with a suit to international organizations in case the state fails to ensure his protection. Tokhian considered as necessary to add to the Constitution the right of citizens to appeal to the Constitutional Court.

Tokhian described as absurd the fact that executive permission is needed for citizens to exercise their constitutional right to form parties or unions with other people–as well as to hold peaceful rallies–marches and demonstrations.

The seminar was organized by the Constitutional Right Center and Ebert Fund.
